TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

1.1 Agreement to Terms:
By downloading, installing, registering, accessing, or using the Love Buddy (https://lovebudy.com/) mobile application and its associated services (collectively, the 'Services'), you ('User', 'you', or 'your') acknowledge that you have read, understood, and unconditionally agree to be legally bound by these Terms and Conditions ('Terms'), the Privacy Policy, and all other policies referenced herein. If you do not agree with any part of these Terms, you must immediately cease using the Application and uninstall it from your device.

1.2 Legal Capacity

By agreeing to these Terms, you represent and warrant that:

• You are at least 18 (eighteen) years of age;
• You have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872;
• You are not barred from receiving services under any applicable law;
• You are a citizen or legal resident of India, or are lawfully accessing the Application from within the territory of India;
• All information you provide is true, accurate, current, and complete.

Love Buddy strictly prohibits use of the Application by persons below the age of 18 years. If Love Buddy discovers that a User is below the age of 18, the account shall be immediately terminated and all data deleted in accordance with applicable law. The Company shall not be liable for any misrepresentation of age by a User.

1.3 Modifications to Terms

Love Buddy reserves the right to modify, update, or replace these Terms at any time without prior notice. Changes shall be effective immediately upon posting within the Application or on the official website. Continued use of the Application after any modification constitutes your acceptance of the revised Terms. It is the User's responsibility to periodically review these Terms.

DISCLAIMER

1.1 Nature of the Platform

Love Buddy is a social networking and online matchmaking platform that enables adult users in India to create profiles, discover and connect with other users, and communicate through text chat and video features. Love Buddy acts as an 'Intermediary' as defined under Section 2(1)(w) of the Information Technology Act, 2000, facilitating user-generated content and communication between users.

1.2 Types of User Accounts

Love Buddy offers two types of user profiles:

1.3. Verification Process

Verification under Love Buddy's identity verification process consists of the following components:

• Mandatory Verification: Selfie-based liveness verification and AI-assisted facial recognition matching is compulsory for every User seeking the Verification Badge. No User shall be granted a Verification Badge without successfully completing face verification.
• Optional Verification: Submission of government-issued photo identification (Aadhaar Card, Passport, Driving License, Voter ID Card) is optional and may be undertaken by the User at their discretion for enhanced trust signalling, but is not mandatory for obtaining the Verification Badge.
• Mobile number verification via OTP (mandatory for all accounts, verified or non-verified)
• Any additional verification steps as may be prescribed by Love Buddy from time to time

Because government ID submission is optional, the Verification Badge confirms only that the User has successfully completed face/liveness verification matching the photographs on their profile, and does not, by itself, confirm the User's legal name, government identity, or background. The Verification Badge signifies only that the User has successfully completed Love Buddy's prescribed mandatory verification process at the time of verification. It does NOT constitute an endorsement of the User's character, intentions, criminal history, or reliability. Love Buddy makes no representation or warranty as to the verified User's behavior, conduct, or intentions within or outside the Application.

2. REGISTRATION AND ACCOUNT RESPONSIBILITIES

2.1. Registration Requirements

To use Love Buddy, you must register for an account by providing accurate, complete, and up-to-date information. You must provide a valid mobile number registered in India or a valid email address. You are responsible for maintaining the confidentiality of your login credentials.

2.2. One Account Per Person

Each individual may maintain only one (1) active account on Love Buddy. Creating multiple accounts for any purpose, including circumventing a ban or suspension, is strictly prohibited.

2.3. Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify Love Buddy at our official grievance email if you suspect any unauthorized use of your account. Love Buddy shall not be liable for any loss or damage arising from unauthorized use of your account due to your failure to maintain adequate security of your credentials.

2.4. Profile Authenticity

You agree that your profile information, photographs, and any content you share on Love Buddy shall be genuine and shall represent your own identity. You shall not impersonate any person, use another person's photographs, create fictitious personas, or misrepresent your identity, age, location, or relationship status. Violation of this clause shall constitute grounds for immediate account termination.

3. USER CONDUCT AND PROHIBITED ACTIVITIES

3.1. General Conduct

Users agree to use Love Buddy in a lawful, respectful, and responsible manner. You shall not use the Platform for any purpose that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.

3.2. Strictly Prohibited Conduct

The following activities are absolutely prohibited on Love Buddy and shall result in immediate account termination, reporting to law enforcement authorities, and potential legal action:

• Posting, uploading, or sharing any content that is obscene, pornographic, sexually explicit, or violates the Indecent Representation of Women (Prohibition) Act, 1986.
• Engaging in or facilitating prostitution, solicitation, escort services, or any form of trafficking in violation of the Immoral Traffic (Prevention) Act, 1956, or the Bharatiya Nyaya Sanhita, 2023
• Harassing, stalking, threatening, or intimidating other users (violates Sections 351, 354D, 506 of BNS 2023 and Section 67 of IT Act)
• Publishing or sharing content that promotes or glorifies violence, self-harm, terrorism, or communal disharmony
• Defaming, libeling, or making false statements about any person
• Collecting or attempting to collect personal data of other users outside the Application's sanctioned features
• Using Love Buddy for commercial solicitation, advertising, MLM schemes, or any unauthorized commercial activities
• Attempting to gain unauthorized access to the Application's systems, servers, or databases
• Sending unsolicited messages, spam, chain letters, or pyramid schemes
• Sharing content that infringes the intellectual property rights of any third party
• Creating fake or bot accounts or using automated means to access the Application
• Sharing another user's private information without their explicit consent ('doxxing')
• Sharing, distributing, or threatening to share non-consensual intimate images in violation of Section 67A of the IT Act and Section 79 of BNS 2023
• Engaging in any activity that violates applicable Indian laws including the BNS 2023, BNSS 2023, POCSO Act 2012, or any other applicable statute

3.3. Content Moderation and Enforcement

Love Buddy employs a combination of automated AI-based moderation tools and human reviewers to monitor content on the Platform. Upon detection of prohibited content or conduct, Love Buddy reserves the right to:

• Issue a formal written warning to the User
• Temporarily restrict specific features of the User's account
• Temporarily suspend the User's account for a defined period
• Permanently deactivate and terminate the User's account without notice or refund
• Remove, disable, or take down any offending content
• Preserve and share relevant information with law enforcement authorities
• Cooperate fully with law enforcement investigations as required under applicable law

Love Buddy's decision regarding enforcement actions shall be final and binding. While Love Buddy may exercise its discretion to issue warnings prior to account termination, it expressly reserves the right to take immediate action, including permanent account deactivation, for serious violations without prior warning.

4. PAYMENTS, SUBSCRIPTIONS, GIFTS, AND REFUND POLICY

4.1. Subscription Fees and Plans & Pricing Section

Access to the Verified Profile features requires payment of the applicable subscription fee. The current plans, namely the Verified Chat Plan and the Verified Chat + Video Plan, together with their respective prices, validity periods, and feature inclusions, are published and displayed in real time on the 'Plans & Pricing' (or 'Gift Store', as applicable) section within the Application. Users must refer to the in-app Plans & Pricing section for the prevailing, currently applicable prices, as such prices are subject to periodic revision by Love Buddy.

All prices displayed on the Plans & Pricing section are inclusive of applicable Goods and Services Tax (GST) as required under the Central Goods and Services Tax Act, 2017, unless otherwise specified therein. Love Buddy reserves the right to revise subscription fees, introduce new plans, or discontinue existing plans at any time, with such changes becoming effective immediately upon publication on the Plans & Pricing section, without requiring a separate amendment to this Clause 4.1.

4.2 Payment Processing

All payments are processed through third-party payment gateways regulated by the Reserve Bank of India (RBI). Love Buddy does not directly store your credit/debit card details, banking passwords, or UPI PINs. All payment transactions are secured through encryption and comply with applicable RBI guidelines and the Payment and Settlement Systems Act, 2007.

4.3 Virtual Gifts and Reward-Sharing Mechanism

Love Buddy may offer a feature through which Users can purchase and send virtual gifts ('Gifts') to other Users within the Application. The following terms govern the Gift feature:

• Gifts are purchased by the sending User using real currency through the Application's payment gateway, at prices displayed on the in-app Plans & Pricing / Gift Store section.
• Upon receipt of a Gift, the receiving User ('Recipient') may claim or redeem the monetary value attributable to that Gift, subject to a 50:50 (fifty-fifty) revenue-sharing arrangement: 50% (fifty percent) of the redeemable value of the Gift shall be credited to the Recipient as redeemable credit or payout (subject to Love Buddy's applicable payout/withdrawal policy, minimum threshold, and KYC requirements), and the remaining 50% (fifty percent) shall be retained by Love Buddy as a platform service fee.
• The 50:50 split described above is a fixed and non-negotiable term of the Gift feature and applies uniformly to all Users, irrespective of Verified or Non-Verified status.
• Love Buddy reserves the right to revise the applicable percentage split, redemption process, minimum payout threshold, applicable taxes (including TDS, where applicable under the Income Tax Act, 1961), and any other term governing Gift redemption, with prior notice published on the Application.
• Any payout of redeemed Gift value to a Recipient shall be processed only after successful completion of Know Your Customer (KYC) verification and subject to applicable tax deduction at source, as may be required under Indian law.
• Love Buddy reserves the right to withhold, reverse, or deny redemption of Gift value in cases of suspected fraud, fake engagement, self-gifting through multiple accounts, or any other manipulative practice intended to artificially generate Gift revenue.

4.4 Refund Policy

All subscription fees and amounts paid for Gifts on Love Buddy are non-refundable except as specifically required under the Consumer Protection Act, 2019. Refund requests may be considered in the following limited circumstances:

• Duplicate or erroneous payment transactions confirmed by Love Buddy's payment records
• Technical failure on Love Buddy's platform that prevented access to paid features for more than 72 continuous hours
• Account deactivation by Love Buddy without cause attributable to User violation of these Terms

Refund requests must be raised within 7 (seven) days of the triggering event via the in-app grievance mechanism or official grievance email. Refunds, if approved, shall be processed within 7-14 business days to the original payment instrument.

4.5 Auto-Renewal

Subscriptions may be set to auto-renew at the end of each subscription period unless cancelled by the User prior to the renewal date. Users will be notified of upcoming renewals. Love Buddy is not responsible for charges resulting from failure to cancel an auto-renewing subscription in time.

5. INTELLECTUAL PROPERTY RIGHTS

5.1. Love Buddy's IP

All content, features, functionality, design elements, software code, databases, algorithms, trademarks, service marks, logos, trade names, and all other intellectual property associated with the Love Buddy Application are the exclusive property of Love Buddy and/or its licensors, and are protected under the Copyright Act, 1957, Trade Marks Act, 1999, and other applicable intellectual property laws of India.

5.2. User Content License

By uploading or submitting content (including photographs, text, audio, video) to Love Buddy, you grant Love Buddy a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, host, store, display, reproduce, modify, and distribute such content solely for the purpose of operating and improving the Application. This license is limited to the operational purposes of Love Buddy and does not permit sale of your content to third parties.

5.3. Ownership of User Content

You retain ownership of all content you post on Love Buddy. However, you represent and warrant that you have all necessary rights, licenses, and permissions to grant Love Buddy the license described above, and that your content does not violate the rights of any third party.

6. ACCOUNT SUSPENSION AND TERMINATION

6.1. Termination by User

You may delete your account at any time through the account settings within the Application. Upon deletion, your profile will be removed from public visibility. Data retention and deletion shall be governed by our Privacy Policy.

6.2. Termination by Love Buddy

Love Buddy reserves the absolute right, at its sole and unfettered discretion, to suspend, restrict, or permanently deactivate any User account without prior notice, in the following circumstances:

• Violation of any provision of these Terms and Conditions
• Violation of any applicable law of India, including but not limited to the BNS 2023, IT Act 2000, POCSO Act 2012, or any other criminal or civil statute
• Conduct that harms, threatens, or endangers other users or third parties
• Fraudulent, deceptive, or manipulative behavior
• Upon direction of competent law enforcement or judicial authorities
• Suspicion of impersonation, fake identity, or bot activity
• Repeated complaints from other users verified by Love Buddy's internal review process
• Any conduct determined by Love Buddy to be detrimental to the reputation, integrity, or safe operation of the Platform

In serious cases involving violations of criminal law, Love Buddy shall cooperate fully with law enforcement authorities and may report the User to the relevant authorities including police, cyber crime cells, and the Data Protection Board of India. Love Buddy's decision to terminate an account shall be final and binding.

7. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

7.1. Disclaimer of Warranties

THE Love Buddy APPLICATION AND ALL SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Love Buddy DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR MALICIOUS CODE.

7.2. No Guarantee of Matches or Relationships

Love Buddy does not guarantee that use of the Application will result in any successful romantic match, relationship, marriage, or any other personal outcome. The Application is a platform that facilitates connections; it does not curate, endorse, or guarantee the character, intentions, or suitability of any User.

7.3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF Love Buddy, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS, FOR ALL CLAIMS ARISING OUT OF OR RELATED TO USE OF THE APPLICATION, SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO Love Buddy IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 500/- (FIVE HUNDRED RUPEES), WHICHEVER IS GREATER.

7.4. Exclusion of Consequential Damages

Love Buddy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF Love Buddy HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.5. Off-Platform Interactions

Love Buddy's services and obligations are limited strictly to the functionality within the Application. When Users choose to meet in person, share contact details, exchange information outside the Application, or engage in any communication or activity beyond the Application's interface, such activities are entirely at the Users' own risk. Love Buddy expressly disclaims any and all liability for events, harms, losses, or damages arising from interactions, meetings, or communications that occur outside the Application's platform.

7.6. Publicly Exposed Contact Information

If a User voluntarily displays, posts, shares, or otherwise publicly exposes their mobile number, email address, social media handle, home address, or any other personal contact information on their profile, in chat, or anywhere within or outside the Application, such disclosure is made entirely at that User's own discretion and risk. Love Buddy shall bear no responsibility or liability whatsoever for any consequence arising from such public exposure of contact information, including but not limited to unsolicited contact, harassment, fraud, impersonation, blackmail, or any other activity carried out by any third party who acquires or uses such publicly exposed information. Any person who chooses to act upon, respond to, or rely on such publicly exposed information, or who engages in any activity (online or offline) as a result thereof, does so entirely at their own risk, and neither Love Buddy nor the User who exposed such information shall be liable for the consequences of any third party's independent actions.

USERS ARE STRONGLY ADVISED TO EXERCISE EXTREME CAUTION BEFORE MEETING ANYONE IN PERSON, BEFORE SHARING CONTACT DETAILS, AND BEFORE PUBLICLY DISPLAYING ANY PERSONAL INFORMATION, AND TO TAKE ALL APPROPRIATE SAFETY PRECAUTIONS. Love Buddy RECOMMENDS MEETING IN PUBLIC PLACES, INFORMING A TRUSTED PERSON OF YOUR WHEREABOUTS, AND NEVER SHARING SENSITIVE FINANCIAL OR PERSONAL INFORMATION WITH ANYONE MET THROUGH THE APPLICATION.

8.INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Love Buddy, its owners, directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms and Conditions
• Your violation of any applicable law or regulation
• Your User Content or information submitted through the Application
• Your violation of any rights of a third party
• Any harm or injury caused by your conduct within or outside the Application
• Any false or misleading information provided by you
• Any consequence arising from your voluntary public exposure of your own contact or personal information

9. GRIEVANCE REDRESSAL

9.1. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Love Buddy has appointed a Grievance Officer whose contact details are as follows:

9.2. Complaint Process

Users may file complaints regarding: (a) violation of these Terms by another User; (b) objectionable content; (c) privacy violations; (d) data protection concerns; (e) account-related issues; (f) Gift redemption or payout disputes; or (g) any other grievance through the in-app report mechanism or directly to the Grievance Officer at the above details.

9.3. Escalation

If you are not satisfied with the resolution provided by Love Buddy's Grievance Officer, you may approach the Data Protection Board of India (for data-related complaints) or file a consumer complaint under the Consumer Protection Act, 2019.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1. Governing Law

These Terms and Conditions, and any dispute, controversy, or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of India.

10.2. Jurisdiction

Subject to the arbitration clause below, the Courts of [City — To Be Specified] shall have exclusive jurisdiction over all disputes arising from or related to these Terms.

10.3. Arbitration

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 and its amendments. The seat of arbitration shall be [City]. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of both parties.

10.4. Consumer Disputes

Nothing in this arbitration clause shall deprive any consumer User of their rights to seek redressal before the National Consumer Disputes Redressal Commission, State Consumer Disputes Redressal Commission, or District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
